Can We Use Alsace-Moselle for Estimating the Employment Effects of the 35-Hour Workweek Regulation in France ? Comment on Chemin and Wasmer (2009)

Matthieu Chemin and Etienne Wasmer’s 2009 article (“Using Alsace-Moselle Local Laws to Build a Difference-in-Differences Estimation Strategy of the Employment Effects of the 35-Hour Workweek Regulation in France”) published in the Journal of Labor Economics finds that the 35-hour workweek did not create jobs. It exploits a natural experiment: three French departments (“Alsace-Moselle”) enforced a reduction in working time of smaller magnitude because in this region firms could integrate two additional public holidays in their calculation, which exist for historical reasons. The 2009 article shows first that employees of this region endured indeed a smaller reduction in working time and second that this smaller reduction in working time was not followed by more unemployment or less job creation. While replicating this article, I discovered a coding error in the definition of firms’ size that seriously undermines the results. Moreover, the article did not take into account that an important fraction of workers in the region were cross-border workers who were not directly subject to the reduction of working time. Correcting for the error in firm definition and excluding the cross-border workers from the sample calls into question the main hypothesis of the article. Reduction in working time, as measured with the French Labor Force Survey, was of similar magnitude in Alsace-Moselle as in the rest of France. Hence my replication cast doubts on the validity of this natural experiment for properly evaluating the impact of the reduction in working time policy on employment.

I sent my comment in december 2016 to the Journal of Labor Economics. Following my comment, the editors finally published in August 2017 the authors’ erratum to the original article. However, they decided not to publish neither my comment nor Matthieu Chemin and Etienne Wasmer’s reply. Therefore readers interested in this debate can find my comment here. L’Alsace-Moselle peut-elle décider des 35 heures ?

L’article de Matthieu Chemin et Étienne Wasmer (“Using Alsace-Moselle Local Laws to Build a Difference-in-Differences Estimation Strategy of the Employment Effects of the 35-Hour Workweek Regulation in France”) publié en 2009 dans le Journal of Labor Economics tente d’établir l’inefficacité de la politique de réduction du temps de travail dite des « 35 heures » en matière d’emploi en exploitant une expérience naturelle : l’Alsace-Moselle a subi une réduction du temps de travail de moindre ampleur que le reste de la métropole car elle a pu intégrer dans son calcul deux jours fériés additionnels qui existaient pour des raisons historiques. L’article de 2009 propose pour cela de montrer d’une part que les salariés de ces trois départements ont connu une réduction de la semaine de travail significativement moindre que ceux du reste de la France et d’autre part que cette différence n’a pas été accompagnée par plus de chômage ou moins de créations d’emploi. Lors d’une réplication de cet article, nous avons découvert une erreur de code informatique dans la définition des entreprises de plus de vingt salariés qui fausse sensiblement les résultats. Sa correction ainsi qu’une meilleure prise en compte du caractère frontalier de la région concernée infirment les hypothèses de l’article. La réduction du temps de travail, telle qu’elle est mesurée par l’enquête Emploi, a été aussi importante en Alsace-Moselle que dans le reste de la France. Ainsi, notre propre travail jette des doutes sur la validité de cette expérience naturelle pour évaluer les effets de la réduction du temps de travail sur l’emploi.
